8. Identity Verification and KYC Compliance

To maintain the integrity of the Sponzar platform, prevent fraud, and comply with Anti-Money Laundering (AML) regulations, we require creators to undergo identity verification before accessing certain features, including payouts.

  • Third-Party Providers: We utilize secure, accredited third-party verification providers (e.g., Datanamix/PBVerify) to validate your identity. By initiating the verification process, you authorize us to share your provided information with these bureaus for the strict purpose of identity validation and fraud prevention.
  • Accuracy of Information: You agree to provide true, accurate, and current information. Providing fraudulent documents, stolen identities, or deepfake/synthetic media will result in immediate account termination, forfeiture of funds, and potential reporting to financial authorities.
  • Verification Fees: Certain verification tiers may incur a processing fee. This fee will be deducted from your Sponzar wallet balance or deferred and deducted from your next payout.

9. Smart Links — Data Processing (POPIA §21 Operator Agreement)

When you use the Sponzar Smart Link feature to collect audience contact details (email addresses, phone numbers, or names) from visitors who click your Smart Link, the following applies:

9.1 Your Role as Responsible Party

Under the Protection of Personal Information Act 4 of 2013 (POPIA), you — the Creator — are the Responsible Party. You determine the purpose for which the visitor's personal information is collected. Sponzar acts solely as your Operator (POPIA §1), processing this information on your behalf and under your authority.

9.2 Your Obligations as Responsible Party
  • Obtain lawful consent: The Smart Link interstitial provides a "Continue without sharing" option ensuring consent is freely given. You must not circumvent this mechanism.
  • Respect the marketing opt-in: You may only send marketing communications (email, SMS, WhatsApp) to audience members who explicitly ticked the marketing opt-in checkbox. Sending unsolicited communications to non-opted-in contacts violates POPIA §69.
  • Handle data subject requests: You must respond to access, correction, and deletion requests from your audience members within statutory timeframes. Sponzar will assist via the Creator Dashboard.
  • Purpose limitation: You must not use audience data for purposes not disclosed at the time of collection.
9.3 Sponzar's Role as Your Operator
  • Stores your audience contact data securely on your behalf
  • Records a consent audit trail for every submission (timestamp, IP address, consent text version, marketing opt-in)
  • Does not use your Smart Link audience data for Sponzar's own marketing without separate, explicit consent from the data subject
  • Does not sell, share, or disclose your audience data to third parties without your written authorisation
9.4 Acceptance

By enabling the Smart Link feature on your account, you accept the role and responsibilities of a Responsible Party under POPIA and agree to Sponzar's Privacy Notice. The full Data Processing Agreement is available upon request.
